- Any PARTY grossing over $10 Million USD (or the exchange rate equivalent, if not in the USA) in any calendar year must contact AUTHOR in writing and receive express written consent permitting usage from the AUTHOR for use of the SOFTWARE in a production environment, public release, or any software where value is intended to be realized. Development and evaluation uses of the SOFTWARE are permitted without contacting AUTHOR. Evaluation period is limited to ninety days from the first date of use by PARTY.
- SOFTWARE and corresponding documentation may not be used to recreate partial or full clone of SOFTWARE without prior written consent from AUTHOR. Clone includes, but is not limited to, any software that uses a significant subset or all of the same semantics as SOFTWARE to bypass the licensing agreement set forth in this document.
- AUTHOR reserves all rights to update and modify this license in future works of the SOFTWARE.

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT.
